Conditions
of Use
By creating and using Gamma Burst electronic
commerce accounts, all account holders, customers and their agents agree
to the following rules:
Service
- These rules are subject to change at any time and continuation
of account service implies acceptance
- Any violation of these rules could result in immediate account
termination at the discretion of Gamma Burst
- Gamma Burst software is available as a service only- it is not
available for free, rent, lease, or sale- unless otherwise obviously
stated
- Gamma Burst retains all rights, copyrights and patents on all
of its software
- No attempt should be made to copy or obtain Gamma Burst software
source code or executables without permission
- Each Gamma Burst account is to be used to serve no more than
one site- multiple sites requre multiple accounts
- Gamma Burst accounts must be used in accordance with their intended
purpose
- Gamma Burst accounts may not be resold or transferred to third
parties in any way
- Nonpayment of account charges will result in the immediate temporary
suspension of account privilages- suspended accounts will be reinstated
upon payment of balances and reinstatement fees
- Gamma Burst services are not to be used in illegal or criminal
activity of any kind
- Gamma Burst reserves the right to add or remove customers at
anytime
- Gamma Burst reserves the right to add or remove services at
anytime
- Gamma Burst reserves the right to change prices at any time
Termination
- Accounts can only be terminated at the end of a billing cycle
- At the time of termination, accounts will be locked and data files archived
- Even though accounts might be terminated, end-user customers have up to 3 (three) years to submit chargebacks, so final payments must be done in a staggared manner
- Payments will be made on the following schedule:
- At the time of termination, funds will be held for 3 (three) billing cycles (months); after which, 90% of the payment will be sent and 10% retained
- After 4 (four) more months 90% (9% of original) will be sent and 10% (1% of original) will be retained
- After another 4 (four) months the entire remainder will be sent
- Beyond this time, chargebacks and fees will be applied to the credit card on file
- If more than one months' payment is retained, each month's payout is treated separately, NOT as a combined unit
- Before sending out payments, all chargebacks and salesdraft requests and fees will be deducted
- Before any payments are sent, a valid credit card with a letter of use for coverage of charges and fees must be on file
- There will no exceptions to these rules
Liability
- Gamma Burst will not be held responsible for any computer down time
or service outages
- All account holders are responsible for paying all charges to their
accounts
- Gamma Burst will not be held responsible for any crimes committed
in any juridiction by account holders, partners or customers using Gamma
Burst Services
- Gamma Burst will cooperate fully with authorities conducting criminal
investigations
- Gamma Burst will not be held responsible for any claims, statements or
assertions made by any account holder at any time on any medium
- Gamma Burst will not be held responsible for the content of account
holder's web pages
- Gamma Burst will not be held responsible for any problems resulting
from the relationship of an account holder and a Web Builder Partner,
any other web site designer, agent or service provider
- Gamma Burst will not be held responsible for fraudulent orders or
fraudulent charges or any kind
- Account holders who use Gamma Billing or Gamma Village services are
responsible to reimburse Gamma Burst for all reversed charges, including
all handling fees
Information
- Account holders are permitted to view only their own password
protect administration pages and related information
- No attempt should be made to view administration pages of other accounts-
any violation will not be tolerated
- Gamma Burst reserves the right to use customer names in promotional
material and in virtual malls
- In order to maintain privacy, all account and customer data is property of
Gamma Burst unless otherwise specified
- Gamma Burst does not guarantee the accuracy of account or customer data
- All account or customer data is provided at the discretion of Gamma Burst
